RETURNS & REFUND POLICY OF WILD WOMEN ON TOP

This Returns & Refund Policy ("Policy") applies to the following purchases: purchases through www.shop.wildwomenontop.com and merchandise purchases only made through www.coastrek.com.au 

General

We offer refunds and replacements in accordance with the Australian Consumer Law and on the terms set out in this Returns & Refund Policy ("Policy").

Any benefits set out in this Policy may apply in addition to consumer's rights under the Australian Consumer Law.

Any benefits additional to the consumer right’s law may be changed or altered at any time at the discretion of Wild Women On Top.

Before making a purchase, please read this Policy so that you can understand your rights and what you can expect from us if you are not satisfied with your order.

Returns and Refunds

We aim to process each order accurately. If a fulfilment error occurs (e.g. you receive the wrong goods), or if you receive damaged goods, please contact us immediately at hello@wildwomenontop.com. Please include photographic evidence showing that the goods received do not match your order (e.g.  incorrect design, style, colour, or size), or showing the damaged goods. We will then offer a replacement at no charge or a refund of the cost paid.  

We also want to ensure your shopping experience with us is a positive one, so for this reason we have a 14-day return policy, which means you have 14 days after receiving your item to request a return. Australian Consumer Law applies to all products we sell, and this Policy does not seek to counter any rights you have under the Australian Consumer Law that you cannot agree to waive or change. Eligible returns will entitle you to a refund or store credit of the item’s purchase price or to exchange the item for another item of the same price. Your original shipping fees cannot be refunded, and all returns must be delivered to our warehouse at your own expense. Store credit will be valid for 12 months from issue.

To be ELIGIBLE for return, your item must be:

  • in the same condition as when you received it
  • must be in new and resaleable condition, unused and unopened in the original box
  • unworn or unused, with tags
  • all packing material, instruction manuals, warranty insert, and other included accessories must be returned in original condition 
  • a receipt or proof of purchase from the Wild Women On Top online store or Coastrek website payment receipt will be required.

An item is NOT ELIGIBLE for return if: 

  • your return request is lodged after 14 days from delivery
  • original packaging is missing, damaged or altered in any way
  • the product has been used, including when we deem there are obvious signs of use, or an admission of use
  • the product is a ‘clearance’, ‘sale’, ‘gift card’ or another item marked as non-returnable
  • the product was not purchased through the Wild Women On Top or Coastrek websites

Wild Women On Top retains the right to refuse any returns if they do not meet our eligibility criteria. Returns that are received and do not meet our eligibility criteria can be returned to you at your expense.

Returns Process

a). If the item/s you want to return meet our eligibility criteria please contact us at hello@wildwomenontop.com or submit a contact request via https://coastrek.zendesk.com/hc/en-us/requests/new in the first instance with your returns information and the reason for your return. We may request photos or videos of the product to assist with the returns process. If we agree your return meets our eligibility criteria we will provide instructions on how and where to send your returns package. Please note we will not accept an item for return unless this process has been followed and returns postage will be at your cost.

b). Unless otherwise defined in our sole discretion, we shall pay all refunds in the same form as the original purchase or to the same account or credit card used to make the original purchase.

d). You may be required to provide a government issued identification to qualify for a refund, repair or replacement.

Availability of Goods

We do not guarantee the availability of any items listed on our websites. By using our websites, you acknowledge and agree that we are not liable for any direct or indirect loss resulting from the unavailability of any item.

Consumer Guarantees

In accordance with Australian Consumer Law our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the product, you are entitled to a replacement, refund or compensation for any reasonable loss or damage.

If there is an inconsistency between this Policy and the Australian Consumer Law, the Australian Consumer Law will prevail. Further information about the Australian Consumer Law and these Consumer Guarantees is available from the website of the Australian Competition and Consumer Commission.

If a product which you purchased from us has a failure which does not amount to a major failure (as defined in the Australian Consumer Law) then you may still be entitled to have the goods replaced.

Change of Mind

We are not required to provide a refund or replacement if you change your mind, however we do offer a 14-day return policy, which means you have 14 days after receiving your item to request a return. Please contact us in the first instance and follow the Returns Process outlined above.

Products may also be exchanged if you chose the incorrect size, however return postage will be at your own cost.

Products Damaged During Delivery

Products may be returned or exchanged if goods are faulty, as long as they are returned to us in their original condition with the tags attached.

In the event that the product you ordered has been damaged during delivery please contact us as soon as possible.

Shipping Costs for Returns (within Australia)

Returns shipping is incurred at your own cost.

In the event that a product you have purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, we shall bear any cost of shipping the said product (the "Returned Product") back to us, as well as any cost of shipping any replacement product to you. Please contact our Customer Service team at hello@wildwomenontop.com for full details on how to proceed.

In the event that we organise and pay for the inspection, postage, shipping, transportation or collection of a Returned Product, and it turns out not to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law ), then you will be required to pay the costs of any inspection, postage, shipping, transportation or collection of the Returned Product.

WWOT offers no return policy for products ordered from and delivered to countries other than Australia.

Response Time

We aim to process any requests for returns or refunds within 5-10 business days of receipt.

Manufacturer Warranties

Certain products purchased from our website may carry a manufacturer's warranty, which is in addition to your rights under Australian Consumer Law. Warranty claims can only be made by the original purchaser with proof of purchase.

Exceptions

Notwithstanding the other provisions of this Policy, we may refuse to provide a replacement or refund for a product purchased by you if:

i) You misused the said product in a way which caused the problem.

ii) You knew or were made aware of the problem(s) with the product or service before you purchased it.

iii) Any other exceptions apply under the Australian Consumer Law.

Wild Women On Top training guides are purchased at your own risk. You accept liability for illness, injury or death to you or those accompanying you partaking in the training referred to in those guides. Wild Women On Top strongly advises you to seek advice from your healthcare professional before starting any training program, and to purchase medical and ambulance insurance for any loss, damage or injury that may arise out of or in connection with trek training and embarking on hiking activities.

Product Information

Wild Women On Top make every effort to ensure products are accurately depicted on our websites however product images and/or video are for illustrative purposes only. Colour variations may occur due to differences in monitor settings, lighting, and other factors. Images may also be cropped to show product details or altered by us for promotional purposes and may not be an exact representation of the product received. Our website may not always display the most current version of items available for purchase.

Information and images about certain products on the Wild Women On Top Shop and/or Coastrek website is based on information or material provided by our third party suppliers and/or manufacturers. There may be slight variations, inaccuracies or errors in the material provided to us and to the extent permitted by law, we cannot be held responsible for any inaccuracies or errors in the information provided to us by a third party. 

Liability

a). To the extent permitted by the Australian Consumer Law and relevant state legislation, the liability of Wild Women On Top for any claims, damages, or losses arising out of or in connection with the goods or services provided, is limited to:

i) the replacement of the goods or the supply of equivalent goods; or 

ii) the payment of the cost of replacing the goods or acquiring equivalent goods

b). Wild Women On Top will not be liable for any indirect, special, or consequential damages, including but not limited to loss of profits, loss of business, or loss of data, arising out of or in connection with the use of the products or services, except to the extent that such liability cannot be excluded by law.

c). Nothing in these terms and conditions excludes, restricts, or modifies any condition, warranty, right, or remedy conferred by the Australian Consumer Law or similar legislation that cannot be lawfully excluded, restricted, or modified. 

d). Wild Women On Top does not warrant that the goods purchased will meet your individual requirements and it is your responsibility to undertake your own enquiries before making a purchase.

e). The total liability by Wild Women On Top for any loss or damage arising under these terms, whether in contract, tort, or otherwise, is limited to the amount paid by the customer for the goods giving rise to the claim.

f). This limitation of liability applies to the fullest extent permitted by law and is intended to be fair and reasonable in the context of the goods and services provided through the Wild Women On Top Shop.

Indemnity

You agree to indemnify and hold harmless us, our employees, directors, officers, agents, contractors, and collaborators from any loss, damage, or legal costs (including lawyer’s fees) incurred as a result of your breach of these terms.
